Q.  Who is required to carry workers compensation?

A.  Generally speaking, All employers in the construction business or trades (that have one or more employees unless they are specifically exempted with the state are required to carry workers compensation insurance. Every other employer in the state of Tennessee that has five or more employees must carry workers’ compensation insurance coverage for their employees.

Q.  How much are the wage replacement benefits if a doctor takes my employee off work?

A.  An employee is entitled to receive 66.67% of their average weekly salary if the injury is compensable and if the amount is within the maximum and minimum amounts established by law. To determine this amount, the employer must submit a Wage Statement. The wage statement will list an injured employee’s gross earnings for the fifty-two weeks prior to the date of injury. The weekly disability benefit rate may not be higher or lower than maximum and minimum rates in effect on the date the employee was injured. To determine the benefit, gross earnings are totaled and divided by 52. The result is the employee's average weekly wage. The average weekly wage is then multiplied by .6667 to calculate the employee's weekly compensation rate.

Q.  What is (CGL) commercial general liability insurance?

A.  Commercial General Liability insurance is coverage for legal liability arising out of your negligence for third party property damage or bodily injury. It is in the best interest of your business to carry a CGL. Without it you are open to many exposures that you could be held liable for.

Q.  What is professional liability insurance?

A.  Professional liability insurance is also known as errors and omissions insurance. It is purchased by architects, insurance agents and engineers as well as doctors, lawyers, accountants, real estate brokers and other licensed professionals to address business liability risks that arise from rendering professional services. Professional liability pays other parties for damages which you are legally liable to pay as a result of negligent acts, errors or omissions in your professional services. Damages can include things such as economic loss and legal expenses. We will defend you against such claims, even if the allegations ultimately are determined to be false.
